The term ‘home office’ or ‘mobile office’ has now become an integral part of our working world, which is relevant for many employees on a daily basis. More and more companies are offering their employees the opportunity to work from home on a daily basis or permanently.
Corona has taken the topic of ‘home office’ to a new dimension. In order to slow down the spread of the virus, the Austrian federal government most recently announced on 26.01.2021 that the use of the home office is not mandatory, but is strongly recommended for all those employees who have the opportunity to do so.
Home office obligations
In any case, the use of home office requires the employer to comply with its own legal provisions. For example, an additional agreement must be made to the regular employment contract so that work can be done from home. This includes, for example, compliance with data protection regulations, which work equipment is provided by the employer or that working hours must be recorded.
In Austria, the same legal regulations apply to the recording of working hours in the home office as in the office. In principle, the obligation to keep records exists for the employer, but the employer can transfer it to its employees.
Handwritten or digital
Whether these records are handwritten or electronically is not regulated by law. The advantages of electronic time recording are obvious: With a web-based and/or app-based solution, modern tools offer the possibility of recording working hours from home or on the road in a simple and uncomplicated way. In addition, unlike handwritten working hours, the electronically collected data does not have to be digitized specifically for payroll accounting.
